Terms and Conditions
1. Provider and scope
These Terms and Conditions apply to consumer purchases of digital products and individual coaching or advisory sessions from Christian Ohm, trading as Liminal Fluency, c/o STARTPLATZ Düsseldorf, Speditionstraße 15A, 40221 Düsseldorf, Germany. Contact: hello@liminalfluency.com.
A consumer is an individual purchasing primarily for purposes outside their trade, business or profession. Purchasers must be at least 18 years old.
These terms cover the products and services described below. Business engagements, subscriptions, group programmes and recorded courses require separate arrangements.
2. Products and services
Liminal Fluency offers downloadable PDF resources and individual online coaching or advisory sessions relating to careers, professional transitions and personal development. The product description and order summary specify what your purchase includes.
Individual sessions last 60 minutes and take place by video call, normally through Google Meet. Another platform may be agreed individually. Sessions are available in English or German.
Multi-session programmes consist of the number of individual sessions stated in the product description. Sessions are scheduled by mutual agreement and should be used within six months of purchase.
Coaching provides a space for reflection, discussion and practical exploration. It does not include psychotherapy, medical treatment, legal advice or tax advice. No particular career, financial or personal outcome is guaranteed.
3. Orders and contract formation
Before submitting your order, you can review your selection, correct your information and view the total price.
By activating the final payment button, you submit a binding offer to purchase the selected products or services. The contract is concluded when I accept your order by email or begin supplying the purchased product or service.
You receive confirmation of the contract by email, including the applicable terms and withdrawal information. Please retain this confirmation. The contractual information is supplied in English.
4. Prices and payment
Prices are stated in euros. The total price is displayed before you place your order. Digital delivery carries no shipping charge.
As a small business under section 19 UStG, I do not charge German VAT.
Payment is due when the contract is concluded. Available payment methods are shown at checkout. Where an instalment plan is offered, the number, amount and timing of instalments are shown before you order, and instalments are charged automatically to the payment method you provide. Any financing option offered by a payment provider is subject to that provider's separate terms and approval.
For the €249 package containing the Transition Map, the Exercise Guide and one 60-minute session, the agreed price allocation is: digital resources €99; individual session €150. This allocation also applies when determining any refund attributable to an individual component. It does not restrict statutory consumer rights.
5. Digital delivery and technical requirements
PDF products are supplied electronically through a download link.
Where you expressly consent to delivery during the withdrawal period and acknowledge the resulting loss of your withdrawal right, delivery begins following successful payment, and you receive a confirmation recording that consent.
You need an internet connection, sufficient storage and software capable of opening standard PDF files. Please save a copy of your purchased files for your own use.
The purchase covers the version described at checkout. It does not include a subscription, future editions or ongoing coaching unless expressly stated. Statutory rights relating to conformity and any legally required updates remain unaffected.

6. Personal-use licence
You receive a non-exclusive licence to use the purchased materials for your own personal purposes. You may save them on your own devices and print copies for your own use.
Except where mandatory law permits otherwise, you may not share, distribute, resell, publish, sublicense or make the materials available to others.
The purchase does not permit you to reproduce or adapt the materials for your own coaching, consulting, training or client sessions. Such use requires separate written permission.
Copyright and other intellectual property rights remain with their respective owners.
7. Booking and attending sessions
Session dates are agreed according to mutual availability. Please provide a valid email address and ensure that you have a suitable device, internet connection and private setting.
A session may take place within 14 days of purchase if you expressly request an early start. Your statutory withdrawal rights are explained separately.
You may reschedule a session once without charge by giving at least 24 hours' notice by email. Requests made later will be considered individually.
Please notify me promptly if you cannot attend. If you culpably miss an agreed session without notice, compensation of €49 may be charged for the resulting loss, provided the flat-rate amount does not exceed the loss ordinarily expected in such circumstances. You may demonstrate that no loss occurred or that the loss was substantially lower, in which case no charge or only the lower amount is payable. No loss will be recovered twice, and payments already retained for the same loss will be credited.
A missed session does not automatically entitle you to a replacement session. Any replacement arrangement will be agreed individually. This provision does not limit your statutory withdrawal or termination rights.
If I need to cancel, you may choose between a replacement appointment and a refund of the affected session. For the €249 package, the session value is €150.
8. Confidentiality
I treat information shared during sessions as confidential and use it to deliver the agreed service. Information may be disclosed where you authorise disclosure, where disclosure is legally required or where it is necessary to establish, exercise or defend legal claims.
Sessions are not recorded. Neither party may record a session without the other's prior express agreement.

9. Withdrawal and statutory rights
Consumers have statutory withdrawal rights as described in the separate Right of Withdrawal notice. To withdraw, an email to hello@liminalfluency.com is sufficient.
The rules for downloadable digital content differ from those for coaching services. Consent to immediate PDF delivery does not, by itself, waive withdrawal rights for a session purchased in the same package.
Your statutory rights concerning defective digital content, non-performance and other breaches of contract remain unaffected.
10. Liability
I am liable without limitation for intentional conduct, gross negligence, injury to life, body or health and under any applicable mandatory liability provisions.
For ordinary negligence involving an essential contractual obligation, liability is limited to loss that was foreseeable and typical for the contract when it was concluded. An essential obligation is one necessary for proper performance of the contract and on which you can normally rely.
Otherwise, liability for ordinary negligence is excluded to the extent permitted by law. These limitations do not restrict mandatory consumer remedies.
11. Applicable law
German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods. Where mandatory consumer protections of your country of habitual residence apply, this choice of law does not deprive you of those protections. Statutory rules on court jurisdiction remain unaffected.
12. Consumer dispute resolution
I am neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body.
